Title IX Accusations: What in the World is Going On?
Recently I’ve seen a large influx in Title IX Cases at universities. In fact, as I am writing this, I currently represent clients in Lubbock, Odessa, Abilene, and Seguin, Texas. Finding an attorney that has handled Title IX investigations is rare, so make sure you ask them about the type of cases they have handled, what was the burden of proof at that specific university, and what were a few of the outcomes related to the case?
You might be asking yourself, what in the world is going on? In four of my recent cases, the Title IX allegation stemmed from incidents that occurred anywhere from 6 months to TWO YEARS prior to today. Most of my clients are hit with a sudden shock or disbelief that something that was so minor a year ago is being brought up, twisted, and manipulated because of a personal vendetta against them. Sometimes the accusations are true, but lately, a majority of the Title IX violations my clients have been accused of were fabricated and we were able to prove it.
All I can tell you to do is stay composed and find an attorney to speak with and make a plan. I like to meet with potential clients and sometimes this initial meeting can take 1-3 hours because we need to cover everything thoroughly. We need to go over your university’s policies and procedures to make sure you understand the process and how things will unfold. Then, we will proceed to review the documentation submitted by the person who filed the complaint. After going over the complaint, I try to have my clients tell me their version of the events with the understanding that I will interrupt or ask questions after for clarification. This can often lead to the hearing of an investigator to help gather documentation if my clients don’t have it readily available.
